Mark Wisniewski is a partner on Berger Singerman’s Business, Finance & Tax team, based in Fort Lauderdale. His practice currently focuses on helping clients resolve tax disputes with the IRS, drafting partnership and operating agreements for real estate joint ventures, federal tax and business planning involving the formation and use of closely held business entities, and tax planning for loan modifications and workouts. Mark handles a wide array of business needs, including corporate transactional work, acquisitions and dispositions of businesses, as well as client restructuring of family business entities for estate planning and gifting purposes. The types of IRS tax matters Mark helps clients resolve include the following: Protest of proposed IRS assessments to the IRS Appeals Division (protests); Tax Court litigation to determine correct amount of tax (deficiency notices) and to appeal CDP determinations; Collections matters, including levies, liens, or withholding of refunds; offers in compromise; collection due process appeals of collection actions (CDP); Trust fund issues resulting from failure to pay payroll taxes where the IRS seeks to assess the trust fund portion (the amount withheld) against the owners, officers, bookkeepers, etc. of a business; Non-filers; the Offshore Voluntary Disclosure Program for people with unreported foreign bank accounts
